MCC PRIVACY POLICY

MOBILE CLIMATE CONTROL places high importance on privacy in compliance with the General Data Protection Regulation (GDPR) and all applicable privacy laws. 

This privacy policy is applicable to the MOBILE CLIMATE CONTROL websites, which can be accessed by different domains owned and managed by the VBG Group AB (publ.). 

We prioritize your privacy and design our sites to comply with privacy laws. This policy explains what personal data we collect, why we collect it, how we use and protect it, and your rights under the GDPR and applicable national privacy laws. Please read carefully to understand how we handle your information.

  3. Collection of general data and information
    The website of MOBILE CLIMATE CONTROL collects a series of general data and information when a data subject or automated system calls up the website. This general data and information are stored in the server log files. Collected may be (1) the browser types and versions used, (2) the operating system used by the accessing system, (3) the website from which an accessing system reaches our website (so-called referrers), (4) the sub-websites, (5) the date and time of access to the Internet site, (6) an Internet protocol address (IP address), (7) the Internet service provider of the accessing system, and (8) any other similar data and information that may be used in the event of attacks on our information technology systems.

    When using these general data and information, MOBILE CLIMATE CONTROL does not draw any conclusions about the data subject. Rather, this information is needed to (1) deliver the content of our website correctly, (2) optimize the content of our website as well as its advertisement, (3) ensure the long-term viability of our information technology systems and website technology, and (4) provide law enforcement authorities with the information necessary for criminal prosecution in case of a cyber-attack. Therefore, MOBILE CLIMATE CONTROL analyzes anonymously collected data and information statistically, with the aim of increasing the data protection and data security of our enterprise, and to ensure an optimal level of protection for the personal data we process. The anonymous data of the server log files are stored separately from all personal data provided by a data subject.

  4. Cookies
    The Internet sites of MOBILE CLIMATE CONTROL use cookies. Cookies are text files that are stored in a computer system via an Internet browser. Many Internet sites and servers use cookies. Many cookies contain a so-called cookie ID. A cookie ID is a unique identifier of the cookie. It consists of a character string through which Internet pages and servers can be assigned to the specific Internet browser in which the cookie was stored. This allows visited Internet sites and servers to differentiate the individual browser of the data subject from other Internet browsers that contain other cookies. A specific Internet browser can be recognized and identified using the unique cookie ID. Through the use of cookies, MOBILE CLIMATE CONTROL can provide the users of this website with more user-friendly services that would not be possible without the cookie setting. By means of a cookie, the information and offers on our website can be optimized with the user in mind. Cookies allow us, as previously mentioned, to recognize our website users. The purpose of this recognition is to make it easier for users to utilize our website. The website user that uses cookies, e.g. does not have to enter access data each time the website is accessed, because this is taken over by the website, and the cookie is thus stored on the user's computer system. Another example is the cookie of a shopping cart in an online shop. The online store remembers the articles that a customer has placed in the virtual shopping cart via a cookie.

    The data processed by the cookies are necessary for the above-mentioned purposes to protect our legitimate interests and those of third parties pursuant to Art. 6 (1) lit. f GDPR.

    The data subject may, at any time, prevent the setting of cookies through our website by means of a corresponding setting of the Internet browser used, and may thus permanently deny the setting of cookies. Furthermore, already set cookies may be deleted at any time via an Internet browser or other software programs. This is possible in all popular Internet browsers. If the data subject deactivates the setting of cookies in the Internet browser used, not all functions of our website may be entirely usable.

  5. Subscription to our newsletter or blog
    On the website of MOBILE CLIMATE CONTROL, users are given the opportunity to subscribe to our enterprise's newsletter or blog. As part of the newsletter/blog registration form, the following personal data is typically processed: 

    • Email address - required for sending the newsletter.
    • First and last name (optional) - used to personalize the newsletter content and salutation.
    • IP address of the device used at the time of registration - for tracking in case of misuse and for legal protection.
    • Date and time of registration - to document when the subscription was made.
    • Proof of consent - to confirm that the individual has agreed to the processing of their data (e.g., through a double opt-in process).

    This data is used solely for sending the newsletter and securing the registration process. It is not shared with third parties. The subscription to the newsletter or blog can be canceled at any time. Consent to receive the newsletter can be withdrawn at any time by using the unsubscribe link included in every newsletter or by contacting our Group Privacy Officer directly via E-Mail at privacy@vbggroup.com

  6. Newsletter-Tracking
    The newsletter of MOBILE CLIMATE CONTROL contains so-called tracking pixels. A tracking pixel is a miniature graphic embedded in such e-mails, which are sent in HTML format to enable log file recording and analysis. This allows a statistical analysis of the success or failure of online marketing campaigns. Based on the embedded tracking pixel, MOBILE CLIMATE CONTROL may see if and when an e-mail was opened by a data subject, and which links in the e-mail were called up by data subjects.

    Such personal data collected in the tracking pixels contained in the newsletters are stored and analyzed by the controller in order to optimize the shipping of the newsletter, as well as to adapt the content of future newsletters even better to the interests of the data subject. These personal data will not be passed on to third parties. Data subjects are at any time entitled to revoke the respective separate declaration of consent issued by means of the double-opt-in procedure. After a revocation, these personal data will be deleted by the controller. MOBILE CLIMATE CONTROL automatically regards a withdrawal from the receipt of the newsletter as a revocation.

  7. Registration on our website
    Users have the option to register on our website by providing personal data. The specific data collected depends on the input fields used during registration. This information is stored and used solely for internal purposes by MOBILE CLIMATE CONTROL and may be shared with processors (e.g., parcel services) acting on our behalf for related internal purposes. 

    When a user registers, the IP address assigned by the internet service provider, along with the date and time of registration, is also stored. This helps us prevent misuse of our services and may support investigations if unlawful activity occurs. This data is only shared with third parties if required by law or for law enforcement purposes.

    Registration allows us to offer content or services that are restricted to registered users. Registered users can update or delete their personal data at any time.

  8. Contact possibility via the website
    The website of MOBILE CLIMATE CONTROL contains information that enables a quick electronic contact to our enterprise, as well as direct communication with us, which also includes a general address of the so-called electronic mail (e-mail address). If a data subject contacts the controller by e-mail or via a contact form, the personal data transmitted by the data subject are automatically stored. Such personal data transmitted on a voluntary basis by a data subject to the data controller are stored for the purpose of processing or contacting the data subject. There is no transfer of this personal data to third parties.

  9. Careers and Job Applications
    Mobile Climate Control (MCC) collects and processes personal data submitted by candidates as part of our recruitment and hiring process. This includes personal information such as your name, contact details, CV/resume, cover letter, qualifications, work history, and any other information you voluntarily provide when contacting us about career opportunities or submitting an application to dl-hr@mcc-hvac.com.

    We process this data for the purpose of evaluating your application, communicating with you throughout the recruitment process, and managing our talent pipeline. Your information may be shared internally with relevant HR personnel and hiring managers, and may also be shared with affiliated MCC companies where applicable, especially for international positions.

    Your application data is retained only for as long as necessary to complete the recruitment process, or longer if legally required or if you have consented to being considered for future opportunities.

  10. Google Analytics (with anonymization function)
    This website uses Google Analytics, a web analytics service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Google Analytics helps us understand how visitors interact with our website, so we can improve its content, performance, and usability. To protect your privacy, we have implemented the „anonymizeIp“ function. This means your IP address is shortened (anonymized) within the EU or EEA before it is sent to Google's servers. Personal identification through the IP address is therefore not possible.
    Google Analytics collects information such as:

    • The website from which you visited us (referrer)
    • Which pages you visited on our site and for how long
    • Your browser, device type, and other standard usage data

    This data is processed for statistical analysis and to help us optimize our online presence. Google Analytics uses cookies to collect this data. You can prevent these cookies from being stored by adjusting your browser settings. You can also prevent Google from collecting and processing your data by installing the browser plugin available at: https://tools.google.com/dlpage/gaoptout.

  11. LinkedIn
    Our website includes features from LinkedIn, operated by LinkedIn Corporation, 2029 Stierlin Court, Mountain View, CA 94043, USA. For users outside the U.S., LinkedIn Ireland Unlimited Company, Wilton Plaza, Wilton Place, Dublin 2, Ireland, is responsible. We use LinkedIn features on the basis of your consent, in accordance with Art. 6(1)(a) GDPR. Consent is collected via our cookie banner and can be withdrawn at any time.

    When you visit a page with a LinkedIn plugin, your browser connects to LinkedIn’s servers. This allows LinkedIn to know that your IP address has visited our site, and it may associate this with your LinkedIn profile if you are logged in.

    If you interact with a LinkedIn plugin (e.g., by clicking a “Share” button), this interaction may be linked to your personal LinkedIn account and stored by LinkedIn. Further information about the LinkedIn plug-in may be accessed under https://developer.linkedin.com/plugins

    LinkedIn may transfer personal data to third countries (such as the U.S.). According to LinkedIn, such transfers are safeguarded using the EU Standard Contractual Clauses in accordance with Art. 46 GDPR.

  12. YouTube
    We embed videos from YouTube, a service operated by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. The implementation is based on Art. 6 (1) lit. f GDPR; our legitimate interest in that case is the smooth integration of the videos and the attractive design of our website.

    When you view a page with an embedded YouTube video, your browser connects to YouTube’s servers. YouTube and Google are then informed about which pages you visited. If you are logged into your YouTube or Google account, this information may be linked to your user profile. To avoid this, you should log out of your YouTube/Google account before visiting our website.

    YouTube's data protection provisions, available at https://www.youtube.com/intl/en_be/howyoutubeworks/privacy/, provide about the collection, processing and use of personal data by YouTube and Google.

  13. Transfer of Personal Data
    We only give your personal data to third parties if:

    • You consented explicitly to the data transfer to a third party according to Article 6 para. 1, page 1 lit. a GDPR
    • The data transfer is required for the contractual performance of the contract with you according to Article 6 para. 1 page 1, lit. b GDPR, such as
      • Data transmission to the mail order firm which will deliver the goods you ordered
      • Payment data transmission to payment service providers and credit institutes for payment transactions 
    • We contracted a processor in accordance to Article 28 GDPR; we especially do so for the erasure of personal data and for the maintenance of our website and intranet.
    • We are legally obligated to surrender the data to financial or judicial authorities according to Article 6 para. 1, page 1 lit. c GDPR. 

    Third parties may use the transferred data only for the above-mentioned purposes.

    Data subjects may ask for further information on the safeguards that are in place to safeguard the transfer of personal data by contacting the Group Privacy Officer at privacy@vbggroup.com.

  14. Routine Erasure and Blocking of Personal Data
    We only retain your personal data for as long as necessary to fulfill the purposes for which it was collected, or as required by applicable laws and regulations.

    Once these purposes have been fulfilled, or if a legally required retention period expires, your data will be routinely deleted or blocked in accordance with the applicable legal requirements.

  15. Rights of the data subject

    • You have the right to withdraw at any time any consent you may have given to us before. Consequently, we may no longer continue the respective activity, Article 7(3) GDPR.
    • You have the right to obtain information on your personal data which we have processed. In particular, you have the right to information on the following: Purposes of the data processing The category of personal data, The categories of recipients to which we disclosed or will disclose your data, The planned storage periods of data, The existence of the right to correction, deletion, restriction of processing and objection, The right to appeal, The right to know the origin of your data in the event that we did not collect these data, The right to meaningful and detailed information on the existence of automated decision-making including profiling and, if applicable, relevant information on the details thereof, Article 15 GDPR.
    • You have the right to obtain without undue delay the rectification of inaccurate personal data and/or the completion of incomplete personal data in storage at the MOBILE CLIMATE CONTROL, Article 16 GDPR.
    • You have the right to the erasure of your personal data unless the erasure interferes with the execution of the right to the free expression of opinions and to information, with the compliance with legal obligations, is necessary in the public interest or for establishing, exercising or defending legal claims, Article 17 GDPR.
    • You have the right to request the restriction of processing of your personal data (Article 18 GDPR), where one of the following applies:
      • The accuracy of the personal data is contested by the data subject, for a period enabling the controller to verify the accuracy of the personal data.
      • The processing is unlawful and the data subject opposes the erasure of the personal data and requests the restriction of their use instead.
      • The controller no longer needs the personal data for the purposes of the processing, but they are required by the data subject for the establishment, exercise or defence of legal claims.
      • The data subject has objected to processing pursuant to Article 21(1) of the GDPR pending the verification whether the legitimate grounds of the controller override those of the data subject.
    • You have the right to receive the personal data concerning you in a structured, commonly used and machine-readable format or to demand the transmit to another controller, Article 20 GDPR.
    • You have the right to lodge a complaint with a supervisory authority. As a rule, you may find such authority at your habitual residence, your workplace or the registered offices of our organization, Article 77 GDPR.
    • Information on your right to object pursuant to Article 21 GDPR.
      You have the right to object at any time, on grounds relating to your particular situation, to the processing of your personal data pursuant to Article 6(1), point (f) GDPR (data processing for the purposes of the legitimate interests) and Article 6,(1), point (e) GDPR (data processing for the performance of a task carried out in the public interest). This shall also apply to profiling as prescribed by Article 4 No. 4 GDPR, which is based on this provision. Once you file an objection, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for processing which override your interests, rights and freedoms, or unless the processing serves the establishment, exercise or defence of legal claims. To the extent that your objection addresses the processing of data for direct advertising, we will stop the processing immediately. In this case, citing a special situation is not required. This shall also apply to profiling in as far as it relates to such direct advertising.

  16. Withdrawing Your Consent
    Where the data subject has provided consent to the collection, use, and disclosure of personal data, the data subject may have the legal right to withdraw consent under certain circumstances. To withdraw consent, if applicable, contact the Group Privacy Officer at privacy@vbggroup.com.

    Please note that if consent is withdrawn, we may not be able to provide the data subject with a particular product or service. We will explain the impact to you at the time to help you with your decision.

  17. Existence of automated decision-making
    We do not use automatic decision-making or profiling.

  18. Changes to our privacy policy
    Any changes we may make to our privacy policy in the future will be posted on this page and, where appropriate, notified to data subjects by e-mail or other electronic means.
